Terms of service
These Terms of Service ("Terms") govern the relationship between you ("Client") and Kane Kaihyou ("Illustrator") regarding the provision of illustration services.
By engaging the Illustrator's services, you agree to these Terms.
Services Provided- The Illustrator agrees to provide illustration services as detailed in the commission. This may include, but is not limited to, character design, concept art, illustrations.Payment- The Client agrees to pay the Illustrator the agreed-upon fee for the services rendered.
- Full payment is required upfront before work begins. The project will not commence until the total fee is received.
- Payments can be made via Easystart.Revisions- The Illustrator offers 4 rounds of revisions based on Client feedback. Additional revisions may incur extra charges.
- Revisions must be requested within 3 days of receiving the initial draft.Ownership and Rights- Upon full payment, the Client will receive the rights to use the final illustrations for the agreed-upon purpose.
- The Illustrator retains the right to showcase the artwork in portfolios, social media, and other promotional materials unless otherwise agreed in writing.Cancellation and Refunds- The Client may cancel the project at any time before completion. However, 50% of the deposit is non-refundable.
- If the Illustrator is unable to complete the project due to unforeseen circumstances, a full refund will be issued.Client Responsibilities- The Client agrees to provide clear and timely feedback, reference materials, and any necessary information to facilitate the project.
- The Client is responsible for ensuring that all provided materials do not infringe on any third-party rights.ConfidentialityBoth parties agree to keep any confidential information disclosed during the project confidential and not to share it with any third parties without prior consent.Limitation of LiabilityThe Illustrator shall not be liable for any indirect, incidental, or consequential damages arising from the use of the illustrations.Amendments
The Illustrator reserves the right to amend these Terms at any time. Clients will be notified of any changes, and continued use of the services will constitute acceptance of the new Terms.Acceptance
By engaging the Illustrator's services, the Client acknowledges that they have read, understood, and agreed to these Terms of Service.
Commercial UsageIf you intend to use my illustrations for commercial purposes, then you must discuss this with me. An additional one-time fee of +100% of the order amount is imposed on the commercial use of my illustrations. Commercial use includes, but is not limited to, illustrations that are used on streams, premieres with the receipt of direct funds through donations, superchats, advertising, etc.
For NSFW and erotic orders, the margin is +100% of the price list
